The use of the website Yoopies.de is subject to the General Terms of Use of
the website Yoopies.de ("General Terms of Use") and to this Privacy Policy
and Personal Data Protection Policy. By using the Yoopies.de website, Users
acknowledge having read, understood and accepted without reservation the
General Terms of Use and this Privacy Policy.
Yoopies may modify and update this Privacy Policy at any time.
The Privacy Policy in force at the time of the use of the Yoopies.de site
are those which are opposable to the User.
You are advised to keep yourself regularly informed of the Privacy Policy
in effect. You may review the current version of the Privacy Policy at any
time by clicking on the " Datenschutz " link.
Clause 1: Definitions
In these General Terms and Conditions, words or expressions beginning with
a capital letter, whether used in the singular or the plural, will have the
following definitions:
“Premium Subscription”: a paid subscription giving access to the paid
services offered by Yoopies.de for a limited period, which is tacitly
renewable for a period equivalent to the initially chosen period.
“Content”: denotes all offers, messages or information of any nature
whatsoever (text, images, videos, photographs, comments, marks, company
names, etc.) uploaded by a Member.
“Data” : denotes personal data enabling the identification of the User.
“Service User”: denotes a Member, a natural person, wishing to hire the
services of a Service Provider via the Platform.
“Service Provider”: denotes a Member registered on Yoopies.de willing to
carry out the Assignment requested by the Service User or offering personal
assistance Assignments to Service Users. A Service Provider may be an
individual or a business which may or may not provide the services in its
own name.
Service Providers with the sole trader status and an authorisation or a
Declaration enabling them to render childminding provisions are assigned
the “sole trader” status on their Yoopies account, considering they also
appear as “sole trader” for Service Users.
The Service Provider may be a nanny, childminder or babysitter.
“Member”: denotes a Service Provider or Service User using the Yoopies.de
platform.
“Assignment”: denotes the service conferred upon the Service Provider by
the Service User.
“Platform”: “denotes the structure put in place by Yoopies, which can be
accessed online at the following address: https://yoopies.de or
https://en.yoopies.de
“Service”: denotes all paid or free services offered by the Platform.
“Personal Assistance Service”: denotes all of the services offered by the
Platform such as nanny services, housework, care for the elderly, tutoring.
“User”: denotes any person using the Platform, whether they are just a
visitor or a Member.
“Verification”: an option indicating whether a profile has undergone
special Verification.
Clause 2: General Privacy Policy Dispositions
This Privacy Policy and Personal Data Protection Policy sets out the terms
under which Yoopies collects, uses, retains and forwards Personal Data
provided by Users or collected by Yoopies from Users of the Platform.

Yoopies undertakes to collect and use Users’ Personal Data in strict
compliance with French legislation on Data Protection, more specifically
the provisions laid down by the French Data Protection Act and by the
European General Data Protection Regulation (GDPR)
4. By using the website, Users accept that their Personal Data will be
treated in the manner and for the purposes described in this instrument.
Users are assumed to have read and understood this Privacy and Personal
Data Protection Policy since it is necessary to accept it at the time of
registration.
5. The Privacy and Personal Data Protection Policy is available on
Yoopies.de at any time and may also be downloaded and printed from the
Platform.
6. The Platform may contain links to other websites owned by individuals,
companies or entities. Under no circumstances is Yoopies responsible for
the content of these websites or for their Privacy and Personal Data
protection Policy.
When Users visit these third-party websites, said websites are likely to
collect Users’ personal data. As a result, Users are asked to take note of
the General Terms and Conditions of Use as well as the Privacy Policy and
any other third-party website document.
Clause 3: Type of data collected by the Platform
Data is collected both via information directly provided by Users and via
actions completed by Users on the Platform (automatically).
Users are informed whether the information to be provided is mandatory or
voluntary at the time of collection.
More specifically, information is gathered when Users: Register, buy a Premium Subscription, proceed to the Verification of the
profile (for Service Providers), contact customer service, run a simulation
estimating childcare costs, reserve online, automates Pajemploi and Cesu
declarations through the Plaform, browse the website and view Service
Users’ or Service Providers’ profiles
• Register on the website
• Purchase a Premium Pass
choose to undergo a profile Verification procedure
• Browse the Yoopies website and view profiles of Families or Service
Providers
• Contact customer services.
3.1 Data collected with information given directly by the User
Some data is mandatory in order for Yoopies to give to the User the
Services, notably the Data given for registration. If this Data is not
given, the User cannot create an account and subsequently cannot use the
Services offered by the Platform. Likewise, if the User does not
communicate his banking details, the User will not be able to buy a Premium
Subscription or to reserve.
The Data collected by Yoopies and given directly by the User may include:
the name, the surname, the password, the postal and mailing address, the
land line number, the mobile number, the date and place of birth,
photographs, education, diplomas, interests, language spoken, economical
and financial information, daily life information (life habits, family
situation), banking detail, identification data, identity document, working
authorisation, working visa, information linked to the Sole Trader Personal
Assistance Services if the User owns such a status.
3.2 Data collected automatically
This Data can include vocal recording when the User contacts Yoopies’
customer service.
It can also include Data when the User connects to the Platform through
social media. In this case, Yoopies can have access to some Data the User
published on the said social media such as the name, surname, photograph,
email address, etc…
Yoopies collects technic data from Users, such as the Internet browser
version, the version of the system exploitation, the IP address,
information identifying the computer or the other device serving to the
visit of the Platform.
Finally, Yoopies can use cookies or equivalent technology, making it
possible to record information linked the User’s browsing (for example:
consulted pages, date and hour of consultation of such pages). This
information enables Yoopies to understand and create audience statistics
but also to understand the user of the Platform by the User in order to
ameliorate the Services and to propose and adapted offer. Any User can
refuse the use of the cookies by Yoopies by modifying the settings of the
Internet browser, the process is available at Clause 17.
3.3. Google Analytics
Yoopies.com uses Google Analytics, a web analytics service provided by
Google Inc. Google Analytics uses "cookies", which are text files placed on
the user's computer, to help the website analyze how users use the site.
The information generated by the cookie about the use of this website is
generally transmitted to and stored by Google on servers in the United
States. However, if anonymization of intellectual property is enabled on
this website, Google will reduce the IP addresses of users in the EU Member
States as well as in other European Economic Area countries. Only in
exceptional cases will the full IP address be transmitted to and shortened
to a Google server in the United States. IP anonymization is active on this
website. On behalf of Yoopies.com, Google will use this information to

provide Yoopies with other services relating to website and Internet usage.

CA 94304 ("Facebook"). Plugins can be recognized by one of the Facebook
logos ("f" white on a blue tile or a "thumb up" sign). The list and
appearance of Facebook Social Plugins can be viewed here:
https://developers.facebook.com/docs/plugins . When a user accesses a
website that contains such a plugin, their browser establishes a direct
connection to Facebook servers. The content of the plugin is sent directly
from Facebook to your browser and integrated into the website. Yoopies
therefore has no influence on the extent of the data that Facebook collects
using this plugin and informs users according to their level of knowledge:
by integrating the plugins, Facebook is informed when a user has consulted
Yoopies.de. If the user is logged into Facebook, Facebook can assign the
visit to their Facebook account. When users interact with the plugins, for

and stored there. If a user is not a member of Facebook, it is always
possible for Facebook to obtain and store their IP address. According to

Yoopies.de uses the Twitter service buttons. These buttons are provided by

are recognizable by terms such as "Twitter" or "Follow us" with a stylized
blue bird. Using the buttons, you can share a message or a Yoopies page on
Twitter or follow the company's account on Twitter. When a Yoopies.de user
calls a website that contains such a button, his browser establishes a
direct connection to the Twitter servers. The content of the Twitter
buttons is transmitted directly from Twitter to the user's browser. Yoopies
therefore has no influence on the amount of data that Twitter collects
using this plugin and informs users according to its level of knowledge.
According to Twitter, only the user's IP address and the URL of the
respective website are transmitted when the button is clicked, which is no

Clause 4: Purpose of data collection
The purpose of the Data collection is to offer Yoopies Users a secure,
optimum, efficient and personalised service. The collect of Data enables:
The use of the Platform
The management, protection, improvement, optimisation of the Platform
Account customisation
Receiving payment and allowing payment for Services
Providing for the Services in accordance with the contracts concluded
between the Member and Yoopies;
Send the user information about the Yoopies' services (e.g. booking confirmations or e-mails concerning payments). This processing is necessary for the fulfillment of the contractual obligations between Yoopies and the member. The legal basis for this is found in Art. 6 para. 1 lit. b DSGVO.
Send the user a newsletter on the condition that the member has given his consent during registration by ticking the corresponding box. The processing is carried out exclusively on the basis of express consent pursuant to Art. 6 para. 1 lit. a DSGVO. This consent can be revoked at any time by deactivating the corresponding box in the users account, clicking on the unsubscribe link in the emails or contacting Yoopies at the following address: kontakt@yoopies.de or dataprotection@yoopies.com

Clause 5: Duration of conservation of Data
Yoopies conserves Data for the time necessary to the operations for which
it has been collected and respecting the applicable legislation.
This duration is of 5 years after the latest use of the Platform if the
Member did not erase his account.
In case the account is erased, the Data is erased totally and definitively
within the best delay and the Data is not retained
“Cookies” are retained for a maximum of 13 months.
Exceptions to the aforementioned durations are anticipated in case Yoopies
has to respect a legal obligation requiring the treatment provided for by
European Union law or by the law of the Member state Yoopies is submitted
to when treatment is necessary to the recognition, exercise or defence of
rights before justice and for other exceptions provided for at Clause 17.3
from the GDPR.
Clause 6: Cookies Management
As a general rule, Yoopies uses cookies in order to improve and personalise
the website and/or determine its audience. Cookies are small files composed
of letters and numbers stored on the User’s browser or on the hard disk of
the terminal used by the User.
Cookies are not used to gather Data without the User’s knowledge, but
instead to record information on how the User browses the website which may
be directly read by Yoopies during future visits and requests by the User,
for example the pages viewed or the date and time at which these pages were
browsed.
Yoopies allows Users to block all cookies. If cookies are blocked, browsing
possibilities will be reduced for certain pages of the website.
Cookies make it possible to recognise Users during their next visit, secure
transactions which Users may make on the Yoopies.de website, register the
language spoken by Users and allow Yoopies to carry out analyses on traffic
visiting the website’s information pages with a view to improving the
content thereof.
Cookies are not automatically activated by default, with the exception of
the cookies needed in order for the Yoopies website and services to
function. In accordance with the regulations in force, Yoopies requires the
User’s consent before activating any other type of cookies.

Clause 7: Recipient of Data
Data may be transmitted
Subcontracting companies (service providers) that Yoopies may call upon for
the execution of its technical services, payment services, moderation and
profile verification or analytical solutions providers. These can be
located within or outside the European Union. Yoopies requires its service
providers to use the Data only to perform the tasks entrusted to them and
to always act in accordance with applicable European data protection
regulations and this Privacy Policy.
By publishing an ad, the Service Users accept that Yoopies relays this ad
to its partners (such as Pôle Emploi for example), in order to maximize
their chances of finding a person corresponding to their expectations. Only
the content of the ad is automatically relayed and published on the site of
the said Yoopies partners. The identity of Service Users remains
confidential and not visible on the advertiser site. To be able to get in
contact with the Service Users, any person interested by the apparent
announcement on the site of the partner, will be automatically redirected
on the Platform Yoopies.de, with obligation of inscription to be able to
contact the Service Users.
Yoopies does not sell or rent the Data to third parties for marketing
purposes without your express consent. When the User authorizes Yoopies and
in accordance with applicable legislation, Yoopies may send Data concerning
Users to its business partners.
If required or permitted by law or if transmission is deemed necessary, in
order to comply with Yoopies' legal obligations, to respond to any claim
against Yoopies, to respond to any legal requests or in the case of surveys
and investigations, to enforce the contract and in particular these General
Terms and Conditions with Members and to ensure and guarantee the rights,
property and safety of Yoopies, its employees and any third parties.
In the event of a sale or purchase of a business or assets, Yoopies
reserves the right to share the Data with the potential seller or buyer of
such business or assets.
The Member's profile is publicly accessible and therefore some Data can be
seen from the public, on search engines, depending on what the User has
been informed about his profile or in his ad, such as for example the first
name, the city, the postal code, the photo, the content of the ad, the
location, the languages spoken, the nationality, the experience, the life
habits, the age group of the youngest child, the professional experiences,
the diplomas.
Clause 8: User’s Rights
If you have any questions regarding the collection, processing or use of
your personal data, information, rectification, blocking or deletion of
data or revocation of consent given or objection to a specific use of data,
please contact us directly via contact data in our legal notices. The right
of access authorizes the User, upon proof of identity and if the conditions
for exercising this right are met, to obtain the communication of the Data
concerning him.
The right of rectification authorizes the User to request that the Data
concerning them be modified, updated or deleted when they are inaccurate or
incomplete.
The right of deletion/erasure authorises the User to demand the deletion of
the Data concerning him/her free of charge, within the limits of the legal
obligations incumbent upon Yoopies. Every User also has the possibility of
deleting his account and his Data which are attached to it.
The right to portability allows the User to receive his Data that he has
provided in a structured format, commonly used and readable by a machine
and to transmit it to another controller.
The right to opposition allows the User to oppose the processing of his
Data for legitimate reasons.
The right to file a complaint with a supervisory authority and the right to
take legal action before the courts if the User considers that his rights
have not been respected.
